India will decide which legal process to follow in returning former Prime Minister Sheikh Hasina to Bangladesh, said International Crimes Tribunal Chief Prosecutor Mohammad Aminul Islam.

Speaking to reporters on Sunday (August 16), he said India could either seek court approval to send Hasina back or hand her over to Bangladesh under the extradition treaty between the two countries. The choice of procedure is an internal matter for India.

Aminul Islam said Bangladesh has already completed the necessary legal procedures to bring Hasina back. He added that it is now up to the Indian authorities to determine which legal framework they will follow.

The chief prosecutor said several cases against Hasina are pending in Bangladesh and she has already been convicted in one case involving crimes against humanity. He said she should be brought back to Bangladesh and face the legal process.

His comments came after an Indian media report suggested that a court process may be required before Hasina can be extradited to Bangladesh. Aminul Islam said Bangladesh cannot determine how Indian authorities will handle the matter under Indian law.
