The final decision on whether to extradite former Bangladesh Prime Minister Sheikh Hasina to Bangladesh will be made by an Indian court, according to reports by Indian media. The reports cited senior Indian government officials as saying that Bangladesh’s request for her extradition would have to go through India’s judicial process.

According to the reports, the matter will not be decided solely on political or diplomatic grounds. The Indian court will examine the extradition request and determine whether the legal conditions for handing her over to Bangladesh have been met.

An Indian official told The Indian Express that the court may also examine whether the offences for which Sheikh Hasina was convicted are considered crimes under Indian law.

The reports noted that Sheikh Hasina has been staying in India since the political upheaval in Bangladesh in August 2024. In November 2025, Bangladesh’s International Crimes Tribunal sentenced her to death after finding her guilty of crimes against humanity. Bangladesh has since been seeking her extradition from India based on that verdict.

The India-Bangladesh extradition treaty signed in 2013 contains provisions for returning people who have been convicted or accused of offences. Although political offences may be excluded, serious crimes such as murder, assault, use of firearms and incitement to murder are generally not treated as political offences under the treaty.
